Common Sex-Related Offences
The most common charges for sex-related offences are:
Rape / Sexual penetration of a child under 16
Indecent assault / Gross indecency
Child pornography offences
These sex-related matters require a detailed analysis of the circumstances surrounding the alleged offence. There are many major issues involved in sexual offences including: the defences of; the age of the accused and complainant; and a denial of any contact.
Sex Offenders Register
Under the Sex Offenders Registration Act 2004, a person who is found guilty of a sexual offence may be subject to significant restrictions and obligations. The consequence of such a conviction is that certain offenders may be listed on the Sex Offenders Register. They may be subject to the imposition of reporting requirements and employment restrictions for an extended period of time.
Extended Supervision Orders
In certain circumstances an application may be made by the Secretary of the Department of Justice for a Supervision Order on an offender. If such an order is granted by the Attorney General, it enables serious sex offenders to be detained in prison after the expiry of their sentences, or to be supervised in the community for a period of time. Leanne Warren & Associates are actively involved in defending any such applications.
